Application of the general terms
1.1 These general terms for online purchase ("General Terms") govern all relations between Brunes sh.p.k and customers wishing to place orders through the website ("customers" or "you").
1.2 By placing orders and making purchases online through the website, you accept all general terms without reservation.
1.3 These general terms apply to all sales through the Brunes website, whether the products are delivered to the address indicated by the customer or collected at Brunes' premises.
1.4 Brunes reserves the right to amend and update the general terms at any time. Amended/updated general terms will be published on the Brunes website. These changes/updates will not apply to orders placed before the publication date.
1.5 For specific products, Brunes may provide special conditions which will apply in addition to these general terms. The special conditions will be defined and published together with the offering of the relevant products.
1.6 Brunes is not liable for any computer viruses that the website may contain. The customer undertakes to use appropriate equipment and software to protect against external attacks (viruses, miscellaneous sites, etc.) when shopping online.
1.7 Brunes may at any time decide to suspend, change or terminate the offering of products online due to maintenance work, to update or improve the site, or for any other reason.
1.8 Brunes may terminate the offering of online purchases or your access to its website due to a breach of these terms by you or for any other reason.
Products
2.1 Customers are informed about the main features of the products on the Brunes website. All information regarding the description of the products, their characteristics and the prices listed on the Brunes website is true, clear and accurate. However, customers are obliged to familiarise themselves with the manner of use or any other information accompanying the delivered products or placed on the product or its packaging, such as the instructions for use.
2.2 The internet offers a different shopping experience than buying in store. The customer must be aware of the colours, dimensions and shapes of each product. The photographs illustrating the products, in support of the text, are not part of the contractual relationship between Brunes and the customer. Brunes accepts no liability in the event of any error in the illustration of the product.
2.3 Brunes does not guarantee the availability of every product published on the website. The availability of products corresponds to stock availability as of the previous business day. In the event of unavailability of a product, Brunes undertakes to inform the customer as soon as possible by any appropriate means of communication.
2.4 Brunes has the right to discontinue online sale of some or all products, temporarily or permanently, with or without notice.
Placing the order
3.1 To make purchases online, the customer must be over 18 years of age and have full legal capacity to act. Brunes is not liable for orders placed by persons under 18 years of age which were regularly carried out through the customer's account. In such cases the customer bears full responsibility and the costs related to the transaction.
3.2 The customer places the order through the procedure described on the website and confirms the detailed order summary, which contains data about the ordered product, the total price of the product (including delivery cost).
3.3 When placing the order, the customer is required to provide truthful and accurate data, mandatory for their identification.
3.4 When placing the first order and/or when registering on the Brunes website, the customer must provide their name, surname, email address and password.
3.5 The password is personal and must be kept secret by the customer.
3.6 For each visit to the website, the customer will have access to their personal data in the customer area, or, if placing an order, must first identify themselves through username and password — bearing in mind that the password is not used to make payments.
3.7 The information recorded by the Brunes system serves as proof of communications, orders and payments made between Brunes and the customers. The verification of the customer's data and the entry of the bank-card number constitute a signature and express acceptance of all transactions carried out on the Brunes website.
3.8 Brunes is not liable for any malfunction of the website that may delay or prevent online ordering due to events beyond Brunes' reasonable control.
Price
4.1 The prices indicated on the Brunes website are net prices including VAT. The prices indicated for products do not include delivery costs which are the responsibility of the customer who chooses delivery to an address designated by them.
4.2 In the event of a writing error regarding the prices of one or more products, Brunes will notify the customer of the error and cancel the order of the relevant product(s).
4.3 Brunes has the right to change prices at any time, without affecting previous orders that have been duly processed and paid by the customer.
4.4 A corresponding invoice is issued for every shipment, which serves, where applicable, as a purchase guarantee and may be printed by the customer from the Brunes website.
Delivery costs
5.1 These provisions apply only if the customer chooses delivery of the products purchased online to the customer's address.
5.2 Delivery costs include order-handling costs and transport costs.
5.3 Product transport costs will be determined according to the total order weight, product dimensions and the customer's location.
5.4 For delivery of products outside the territory of Albania, special conditions or additional costs apply, of which the customer will be informed via the Brunes website during ordering or before shipment.
5.5 Product delivery costs are determined when the order is placed on the Brunes website.
5.6 Order-handling costs are fixed and include the costs of order preparation, packaging, relevant wrapping and the insurance that guarantees safe transport to the customer's address.
5.7 The customer accepts that they are fully informed about the payment of delivery costs (handling and transport) added to the price of the ordered products.
Order confirmation
6.1 After placing the order, Brunes confirms receipt of the order to the customer by assigning an order number. The customer will receive an email confirming the online purchase, containing information on the product, quantity, price and order number.
6.2 The customer's order will be considered accepted only after its confirmation by Brunes. The confirmation date appears in the email sent to the customer.
6.3 For special orders, Brunes has the right to request additional information from the customer. In this case, the customer is notified by email of the documents to be sent in order to receive final confirmation of their order. Brunes reserves the right to cancel an order if the customer does not provide the requested documents or information, or if these documents are not deemed appropriate.
6.4 The customer's order may be cancelled by Brunes for any reason, in particular in the absence of mandatory information for shipment of the order. Brunes will inform the customer accordingly.
Payment
7.1 The price of the products and delivery costs shall be paid by the customer at the time the order is placed online on the website.
7.2 The customer may pay by:
- Debit or credit bank card (Visa Card / MasterCard)
- PayPal
- Payment to a bank account
- Cash on delivery in Lek (up to the legal cash-transaction limit)
7.3 If Brunes is unable to fulfil part of the customer's order, the customer's payment will be reduced by the price of the undelivered products and the corresponding delivery costs.
7.4 Brunes uses computer programs approved by Visa International and MasterCard Worldwide with the latest security standards (128-bit SSL Secure Socket Layer).
7.5 When making the payment, the customer is automatically connected to the payment server, part of the bank's data-processing-centre control system.
7.6 The customer's bank data, protected by encryption, do not pass through Brunes' electronic systems and are not stored on Brunes' electronic systems.
Delivery of products
8.1 All purchases confirmed before 18:00 on official working days will be processed and shipped within 2 hours in the cities of Tirana, Durrës, Krujë, Fushë-Krujë and Kavajë. For other cities the order will be processed and shipped on the next business day. For the areas Tropojë, Has, Pukë, Gramsh, Ersekë/Kolonjë you will be contacted by phone for transport details. Delivery is performed by courier and will arrive no later than 3 days depending on your location. You will be notified by email when your order ships. Orders placed during weekends or on official holidays will be processed on the next business day.
8.2 Delivery of products may be carried out only within the territory of the Republic of Albania, the Republic of Kosovo, the Republic of Montenegro, the Republic of North Macedonia, the Republic of Serbia and the Republic of Bosnia and Herzegovina. The delivery deadline may be extended depending on the customer's location, but in any case will not exceed 30 (thirty) calendar days from the day following order confirmation.
8.3 If the delivery deadline is to be postponed, Brunes undertakes to inform the customer as soon as possible by any means of communication so that the latter may choose whether to keep the order or to cancel it in whole or in part.
8.4 Brunes is not responsible for the consequences of events beyond its reasonable control, such as force majeure or events depending on the carrier, which would delay or prevent the delivery of the ordered products.
8.5 Delays in delivery or non-fulfilment of the order may not give rise to compensation for the customer or its suppliers.
8.6 Brunes, through the carrier, will deliver the ordered products to the address designated by the customer, at the closest accessible point for the vehicle. The carrier also undertakes, against payment, the loading and unloading of the products.
8.7 Product delivery does not include assembly or commissioning of the products. These services are offered against payment.
Receipt of delivery
9.1 The customer undertakes to receive the products in their own name or in the name of the person on whose behalf the order was placed, at the address indicated by them when placing the order.
9.2 Upon delivery, the customer or the authorised person must prove their identity and the order confirmation containing the order number, as well as authorisation in the case of pickup by a third party.
9.3 When checking the delivered products, if the customer notices that the packaging is damaged or that products are missing or damaged, they must describe all observations in writing on the delivery receipt and obtain the carrier's signature, retaining a copy of the document. These observations must be clear (description of the damage) so that they can be considered by Brunes for product replacement.
9.4 WARNING: In the event of damage to the packaging during transport, the customer undertakes to refuse delivery of the damaged products, stating the reason for the refusal on the delivery receipt.
9.5 By signing the delivery receipt without any observation and accepting the products, the customer accepts that the products have been delivered in good condition. From this moment the customer loses the right to return or replace the delivered products.
9.6 In the event of observations regarding the delivery of damaged products or products that do not conform to the quality or quantity ordered, the customer undertakes to notify Brunes in writing, specifying the order number.
9.7 Brunes will redeliver the correct order within 7 (seven) days of receiving the above notification.
9.8 If the product you have ordered is no longer available, Brunes will refund the purchase value within 14 (fourteen) days.
9.9 If Brunes or its carrier is unable to deliver the products through the customer's fault — for example, failure to comply with the agreed delivery time or failure to communicate special access conditions — the customer loses the right to reimbursement of delivery costs. The cost of returning the product will also be deducted from the refund of the product price. If the customer wishes another delivery, they must again pay the delivery costs in advance.
9.10 Specific transport vehicles are required for delivery of large-dimension products. These products will be delivered to the customer at the closest point accessible to the vehicle near their residence and under normal access conditions for a 10-tonne truck. The customer ensures that the road infrastructure to the indicated address allows passage of a 10-tonne truck.
9.11 If access to the customer's residence does not meet these conditions, the customer must notify Brunes and provide details of the access problems at the time of placing the order, in order to find the most suitable solution for product delivery.
Order cancellation
10.1 The customer has the right to cancel their order in the event that Brunes fails to comply with the delivery deadline provided in Section 8 above, by notifying the Brunes Customer Service in writing.
10.2 The cancellation request will be considered by Brunes only if the preparation, dispatch or delivery of the ordered products has not occurred between the date of dispatch and the date of receipt of the request.
10.3 In the cases of cancellation above, the customer will be reimbursed for the payment made within 14 (fourteen) days of receiving the written request by Brunes.
10.4 Brunes has the right to cancel the customer's order if the infrastructure of the customer's residence, where the product delivery is to be made, does not physically allow access of the transport vehicle or unloading of the products. In this case, Brunes will refund the price of the product, deducting the outbound and return transport costs.
Withdrawal from contract – Product return
11.1 Pursuant to Article 37 of Law 9902, dated 17.04.2008, as amended by Law No. 10 444, dated 14.7.2011 "On Consumer Protection", the customer has the right to withdraw from the contract without penalty and without giving a reason within 14 calendar days from the delivery date of the ordered products.
11.2 The product must be returned to the address designated by Brunes, with its packaging, unused, accompanied by all accessories, instructions for use, documents proving the online purchase, and the completed return authorisation form. If the customer wishes to return construction-department products, the return will be accepted only if the entire purchased quantity of the item code is returned.
11.3 Returned products that are deficient, damaged, used or soiled cannot be accepted by Brunes.
11.4 The customer will be reimbursed the product price. The cost of returning the product is borne by the customer. Refunds will be made by payment to the customer's bank account.
11.5 Promotional products and made-to-order products (rugs, carpets, cables, etc.) cannot be returned by the customer under any circumstances.
Privacy protection
12.1 Brunes has the IT means for processing the data of prospective customers and online purchases, and in this context carries out the collection and processing of personal data within the meaning of Law 9887, dated 10.03.2008, as amended by Law No. 48/2012 and Law No. 120/2014, "On the Protection of Personal Data".
12.2 The protection of privacy and personal data are matters of particular importance, and Brunes is committed to rigorously enforcing the entire legal framework for their protection and respect, in particular Law 9887, dated 10.03.2008 (as amended), as well as the related sub-legal acts.
12.3 In relation to the collection and processing of personal data, Brunes has fulfilled all mandatory preliminary formalities with the Commissioner for the Protection of Personal Data.
12.4 The main purpose of processing personal data is to ensure correct delivery of orders placed through the Brunes website, improve service quality, and communicate information about orders placed and Brunes offers that may be of interest to the customer and best meet their expectations. Brunes obtains the customer's prior consent regarding the communication of promotional offers to the customer's personal phone number. The customer has the right at any time and free of charge to refuse the communication of promotional offers from Brunes.
12.5 Personal data are stored by Brunes for use of the service and may be communicated to Brunes' commercial partners only with the customer's prior approval. Brunes reserves the right to transfer data only to its sub-contractors, who may be located outside Albania, in accordance with the legislation in force on the transfer of personal data, and enters into contractual relations with such sub-contractors to ensure all security measures for the protection and confidentiality of personal data.
12.6 Brunes will retain the personal data of customers who visit and carry out transactions on the Brunes website for a period of two years from the date of the customer's last visit, except in the event of disputes between the customer and Brunes regarding the transactions carried out, in which case this retention period may be extended.
12.7 Personal data are protected through the password you use to make online purchases. The customer undertakes to keep this password confidential at all times.
12.8 If the customer believes or suspects that their account is at risk, Brunes must be notified immediately.
12.9 In accordance with the legal framework, the customer has the right to access, correct, delete their personal data or object to its processing. The customer may exercise these rights at any time by contacting Brunes.
Transfer of ownership
13.1 Brunes reserves ownership of the delivered products until full payment of the price by the customer has been completed (transfer of funds to Brunes' bank account).
Customer service
14.1 After-sales services will be provided only for those products for which a guarantee is offered, when this is specified in the product description at the time the customer places the order.

Intellectual property rights
15.1 This website is the official Brunes website. All elements used on this site, including visual or audio elements and the underlying technology, are protected by copyright, trademark or patent. They are the exclusive property of Brunes sh.p.k.
15.2 This site is used under the general terms expressly defined herein. The customer has the right to use this site only for personal use, and any unauthorised copying or use of the elements employed on this site is prohibited.
15.3 The customer is prohibited from using hypertext links to the Brunes site and from using framing or deep-linking techniques.
Applicable law and jurisdiction
16.1 These general terms are governed by and construed in accordance with the legislation of the Republic of Albania.
16.2 Disputes between Brunes and the customer regarding the application of these general terms shall be settled by the District Court of Tirana.
